§ 30-4. Litter regulations, violations and penalties; provisions to apply outside of municipality.

  • (a)

    [Whoever violates sections 30-2 or 30-3 shall, for the:]

    (1)

    First offense. Warning by the city police department.

    (2)

    Second offense. Ten days jail, suspended on performance of 36 hours community service work on litter detail.

    (3)

    Third offense. Twenty-five dollar fine and cost plus ten days in jail, suspended on performance of 72 hours community service work on litter detail.

    (4)

    Fourth offense. One hundred dollar fine and costs plus 30 days in jail, suspended on performance of 30 days community service work on litter detail.

    (5)

    Fifth offense. Two hundred fifty dollar fine and costs plus 30 days in jail, suspended on performance of six months community service work on litter detail.

    (6)

    Sixth offense. Five hundred dollar fine and costs plus 30 days in jail, suspended on suspension of driver's license for six months.

    (b)

    The terms of sections 30-2 and 30-3 shall apply not only within the corporate limits of the city, but shall also apply to all property owned, leased and operated by the city, all of which is within five miles of the said municipality.
