§ 26-200. Definitions.

For the purposes of this subchapter, the following terms, phrases, words and their derivations shall have the meaning given herein.

When not inconsistent with the context, words used in the present tense include the future, words in the plural number include the singular number and words in the singular number include the plural number. The word "shall" is mandatory.

Basic cable television service means those services provided by the company to all subscribers for a single monthly fee.

(2)

Cable television system means a system of antenna, cables, amplifiers, towers, microwave links, waveguides, laser beams, satellites, earth stations, or any other conductors, converters, equipment or facilities, designed or constructed for the purpose of producing, receiving, amplifying, storing, processing or distributing audio, video, digital or other forms of electronic or electrical signals.

City means the City of Leesville, a political subdivision of the State of Louisiana and all territory within its present or future geographic boundaries.

(4)

Company means Suddenlink Communications, the grantee of the rights under the subchapter, its successors and assigns.

(5)

Federal Communications Commission or FCC means that federal agency established by the Communications Act of 1934 or any successor agency as established by congress.

(6)

Gross annual subscriber receipts shall mean the compensation, in whatever form, received by the company from subscribers for the provision of cable television service within the city. Gross annual subscriber receipts shall not include receipts derived from installations or any taxes on services furnished by the company imposed directly on any subscriber by any municipal, county, state or other governmental unit.

(7)

Street means the surface of and the space above or below any public street, sidewalk, alley, easement or other dedicated public way of any type whatsoever, now or hereafter existing as such within the jurisdiction of the city.

Subscriber means any person, firm, corporation or other entity receiving a service by means of the company's cable television system.
